Family mediation is a popular way to resolve family law issues, including disputes about:

  • Which spouse should start divorce proceedings and the basis for the divorce proceedings;

  • Divorce and financial claims about the family home and whether property should be sold or kept by one spouse, pensions and whether they should be shared , resolving ownership of the family business and its assets, sorting out spousal maintenance and child support;

  • Parenting arrangements after separation, including whether care of a child should be shared equally or not and custody and access arrangements;

Family mediation

Court rules say that, in a number of family law situations, couples must either attend mediation sessions or get a family mediator to sign a form to say that mediation is not appropriate for them, before they can start family court proceedings.  

If family mediation is started but a couple cannot reach an agreement during the mediation sessions then the mediator will sign a form that enables a court application to be made.

What is family mediation?

In family mediation, a couple speak to a mediator to help them resolve a family law dispute. A family mediator is impartial and does not take sides.

The mediator is there to help facilitate an agreement, so that the couple do not have to start or continue with family court proceedings.

A family mediator cannot:

  • Give you or your former partner any legal advice;

  • Tell you what to do;

  • Force you to reach an agreement;

  • Prepare the legal paperwork needed if you do reach an agreement in mediation. The family law paperwork needed can vary from starting divorce proceedings, preparing a separation agreement, or drafting a financial court order or child arrangements order.

Mediation support

  • Helping you decide whether you need expert reports to reach a mediated agreement, for example a property valuation or a pension actuarial report; and 

  • Giving you legal advice between mediation sessions so you can understand your legal options to help you have the confidence to put your points across in mediation and reach an agreement; and

  • Advising you on the pros and cons of any suggested mediation agreement and the potential costs of any family law court proceedings so that you can weigh up whether a proposed mediation agreement is in your best interests; and

  • If agreement is reached, reviewing the memorandum of understanding prepared by the family mediator and preparing the necessary legal paperwork for you and implementing any order, for example, a pension share or property transfer; and

  • If agreement cannot be reached, representing you on court proceedings to achieve the best outcome for you and your family.
